FMLA

The Family and Medical Leave Act, or FMLA, provides up to 12 weeks of unpaid leave to qualifying employees for the "serious medical condition" of a parent, a child or themselves. Under FMLA and the California Family Rights Act (CFRA), employers that regularly employ more than 50 people within a 75-mile radius must provide this leave. Also, employees who are pregnant and have a pregnancy related disability can take pregnancy disability leave in addition to leave under CFRA.

You have the right to file for FMLA. If you were denied, call us toll free at 800-483-1890.

An employee returning after FMLA or CFRA leave generally has the right to the following:

  • To return to his or her prior position or an equivalent position
  • The same pay and benefits
  • The same terms and conditions of employment as he or she had before

If you have been terminated, given a lesser position or otherwise discriminated or retaliated against after taking FMLA leave, or have been prevented from taking a leave, a knowledgeable attorney can help.
