    • Can both parents use FMLA leave?
      Yes, both parents may be eligible for FMLA leave for the birth, adoption, or foster care placement of a child. However, if both work for the same employer, they may be limited to a combined 12 weeks of leave for these purposes.
    • Who is eligible for FMLA leave?
      An employee is eligible for FMLA leave if they have worked for their employer for at least 12 months, clocked at least 1,250 hours over the past 12 months, and work at a location where the company employs 50 or more employees within 75 miles.
    • How is FMLA leave requested?
      To request FMLA leave, an employee should notify their employer as soon as possible, ideally providing at least 30 days notice when foreseeable. The employer may require a certification from a healthcare provider to substantiate the need for leave.
    • What reasons qualify for FMLA leave?
      FMLA can be used for the birth or adoption of a child, to care for an immediate family member with a serious health condition, the employee's own serious health condition, or any qualifying exigencies related to a family member’s military service.
