Types of Workplace Disability Discrimination
There are many ways workers with disabilities are discriminated against. If you are being unfairly treated due to your disability or accommodations, are being harassed, or are experiencing retaliation after discussing your disability, you are likely experiencing discrimination.
Common forms of disability discrimination include:
- Being denied reasonable accommodations. Employers are required to provide accommodations that allow an employee with a disability to complete work duties. While accommodations can’t cause undue hardship on an employer, over half of accommodations have zero cost for employers.
- Refusing to discuss needed accommodations. An interactive process of discussion between employers and employees can be used to determine what accommodations are effective and reasonable. It is illegal for your employer to refuse to discuss your accommodations or requests with you.
- Making hiring and firing decisions based on a disability. For adults aged 21-64, 10.8% are unemployed and seeking employment. Requiring accommodations should not impact whether you are hired or fired from a job. It is illegal for an employer to reject a qualified applicant or fire an employee with good performance due to their disability.
- Unfairly paying or scheduling employees with disabilities. Being paid less than your peers without a disability, despite equal performance and duties, is a form of disability discrimination. So is being underscheduled due to a disability or being scheduled when you have an accommodation for time off, such as for medical treatment.
