Miscalculating the 50-Employee or 75-Mile Rule
One of the most common tactics is for employers to claim they are not covered by the FMLA. Companies may intentionally miscalculate employee headcounts to keep themselves under the 50-employee threshold that triggers legal protection. Or, they may ignore nearby facilities within a 75-mile radius, which still qualifies you for legal protection.
