California’s Fair Employment and Housing Act (FEHA) recognizes two distinct forms of workplace sexual harassment. Understanding which applies to your situation shapes how a claim is built and pursued.

This form occurs when unwelcome sexual conduct is severe or pervasive enough to interfere with your ability to do your job. It can involve comments, gestures, images, or physical contact. Quid Pro Quo Harassment
This occurs when someone in authority ties job benefits, promotions, raises, or continued employment to submission to sexual advances or requests. It’s one of the clearest abuses of workplace power, and California law treats it seriously.
FEHA sets a higher standard than federal law under Title VII of the Civil Rights Act. Unlike federal protections, FEHA’s harassment provisions cover all California employers regardless of size. They extend to employees, job applicants, unpaid interns, volunteers, and contractors. California law also places an affirmative obligation on employers to prevent harassment before it occurs, not simply to respond after the fact.
